Terms of Service

These Terms of Service ("Terms") govern your use of The Diplocat mobile application and website at diplocat.app (the "Service"), operated by Entelechy Unbound, LLC ("we", "us", or "our"). By using the Service, you agree to these Terms.

1. Service Description

The Diplocat is an AI-powered communication practice tool that suggests alternative phrasings across four de-escalation levels. The Service includes text and voice input, AI-powered translation, audio playback, and conversation history.

The Diplocat is not a substitute for professional counseling, therapy, mediation, legal advice, or crisis intervention. The Service uses AI to suggest alternative phrasings — it does not provide psychological, medical, or legal guidance.

2. Account Registration

• You may create an account using email, Apple Sign-In, Google Sign-In, or use the app anonymously with limited features.
• You are responsible for maintaining the security of your account credentials.
• You must provide accurate information and keep it up to date.
• You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service.

3. Subscriptions and Billing

• The Service offers Free, Basic, and Premium tiers with different feature sets and usage limits.
• Paid subscriptions are billed monthly through Apple's App Store or Google Play Store.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
• Refunds are handled by Apple (for App Store purchases) or Google (for Google Play purchases) in accordance with their applicable policies.
• We reserve the right to change pricing with reasonable notice. Existing subscribers will be notified before any price changes take effect.

4. Acceptable Use

You agree not to use the Service to:

• Harass, threaten, or harm others
• Generate content that is illegal, hateful, or promotes violence
• Attempt to circumvent usage limits, security measures, or access controls
• Reverse-engineer, decompile, or disassemble the Service
• Use automated tools, bots, or scripts to access the Service without authorization
• Resell, redistribute, or sublicense access to the Service

5. Content Ownership

• Your Content: You retain all rights to the original text and voice content you submit. By using the Service, you grant us a limited license to process your content for the purpose of providing the translation service.
• AI-Generated Output: The diplomatically rephrased text generated by the Service is provided for your personal use. You may freely use, share, and copy the generated output.
• Our Content: The Service, including its design, code, AI models, and branding, is our intellectual property and is protected by applicable laws.

6. AI-Generated Content Disclaimer

The Service uses artificial intelligence to rephrase messages. While we strive for accuracy and appropriateness:

• AI-generated content may not always perfectly capture your intended meaning.
• The Service is a communication aid, not a substitute for professional mediation, legal counsel, or mental health services.
• You are responsible for reviewing AI-generated output before sending or sharing it.
• We do not guarantee that AI output will achieve any particular outcome in your communications.

6.5 Safety & Crisis Situations

Important Safety Information: The Service is not designed for use in crisis situations including but not limited to domestic violence, self-harm, or situations involving immediate physical danger. If you or someone you know is in danger, contact emergency services (911), the National Domestic Violence Hotline (1-800-799-7233), or the 988 Suicide & Crisis Lifeline. The AI may not recognize dangerous situations and its suggestions should never be relied upon as safety advice.

6.6 Assumption of Risk

By using the Service, you acknowledge that AI-generated suggestions may be inaccurate, inappropriate, or incomplete. You assume full responsibility for how you use AI-generated output in your communications. We strongly recommend reviewing all suggestions before sending them to others.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

8. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available" without warranties of any kind.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
• We are not responsible for any consequences resulting from your use of AI-generated output in real-world communications.
• We are not liable for any harm resulting from reliance on AI-generated suggestions in situations involving domestic violence, abuse, harassment, self-harm, or any other dangerous circumstances.

9. Service Availability

We aim to provide reliable service but do not guarantee uninterrupted availability. We may temporarily suspend or modify the Service for maintenance, updates, or other operational reasons.

10. Termination

• You may stop using the Service and delete your account at any time through the app settings. Your account will be deactivated immediately and all data permanently deleted within 30 days. You may contact us within this period to recover your account.
• We may suspend or terminate your account if you violate these Terms, with or without notice depending on the severity of the violation.
• Upon termination, your right to use the Service ceases immediately. Data deletion follows the timeline described in our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes through the app. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

12.5 Dispute Resolution

Any dispute arising from these Terms shall first be submitted to good-faith informal resolution by contacting support@diplocat.app. If unresolved within 30 days, disputes shall be resolved by binding arbitration under the rules of JAMS in California. You agree to waive any right to a jury trial or to participate in a class action.
